Can I reserve a car-park space by standing in it?

Finding a car park can be a frustrating endeavour at the best of times but imagine approaching what you think is a free space before noticing a person standing in it.

Considering the alternative perspective, maybe you’re the person reserving the car park for a friend or family member.

There have been several occasions where this has played out, with videos uploaded to social media. And as expected, many people have voiced their opinion on the car-park tactic.

Is it illegal to reserve a car park by standing in it?

While there isn’t a specific rule prohibiting a pedestrian from reserving a car park by standing in it, they could potentially be breaking another road rule.

The Australian Road Rules state that pedestrians must not cause a traffic hazard by moving into the path of a driver and must not unreasonably obstruct the path of any driver.

Off-street car parks open to or used by the public are still considered a road-related area, and the Australian Road Rules still apply.

In SA, a pedestrian obstructing the path of a driver can receive a $59 fine, plus a $102 Victims of Crime Levy.

Staying safe

It might be rare to receive a fine for reserving a car park by standing in it, but the pedestrian could be risking their safety.

At worst, the motorist might not expect to see a pedestrian standing in the car park and hit them, leading to serious injuries.

As seen in social media videos online, the act could lead to an altercation, road rage and even violence. On one occasion, the pedestrian shouted at the driver and grabbed on to the vehicle in protest. It’s a dangerous move that could end up with them getting hurt.

Instead of reserving a parking space by standing in it, you might just have to trawl the car park for a space. Even if that means keeping an eye out for pedestrians approaching their car as they leave the shopping centre.
